Athenia Rodney
Defendant - Appellant.
Appeal from the United States District Court
for the Eastern District of Texas
USDC No. 1:99-CR-14-3
Before WIENER, EMILIO M. GARZA, and PRADO, Circuit Judges.
PER CURIAM:*
Athenia Rodney appeals from his conviction for the sexual abuse of a
minor in violation of 18 U.S.C. § 2241(c). Rodney raises six issues relating
to his conviction, including one challenge to his custodial conviction.
Pursuant to 5TH CIR. R. 47.5, the court has determined that this opinion
should not be published and is not precedent except under the limited
circumstances set forth in 5TH CIR. R. 47.5.4.
No. 01-50672
Rejecting Rodney’s first challenge, see United States v. Smith, 220 F.3d
677, 677 (5th Cir. 2000), he raises two challenges to his custodial conviction.
First, he asserts that the district court erred by finding at the initial plea
hearing that the evidence at trial was sufficient to establish the offense of
conviction. Second, he asserts that the district court erred by using his prior
convictions, rather than new ones, in calculating his criminal history.
